Terms & Conditions

1. Purpose

The purpose of these General Terms of Sale is to define the contractual relationship between Fly for Kidz, operated by María López Baños as an independent sole proprietor, and any natural or legal person wishing to make a purchase through the website www.flyforkidz.com (hereinafter referred to as “the Customer”), as well as to set out the conditions applicable to all purchases made via the online shop, whether by a professional or a consumer.

By placing an order on this website, the Customer acknowledges and accepts these General Terms of Sale in their entirety.

These general terms of sale prevail over any other general or special conditions not specifically approved by Fly For Kidz sole proprietor. Fly For Kidz sole proprietor reserves the right to modify its terms of sale at any time. In this case, the applicable terms will be those in effect on the date of the order by the Customer. The Customer is responsible for regularly checking the content of and any changes to these terms by visiting the following url: www.flyforkidz.com/policies/terms-conditions

These General Terms of Sale are available in English, French, German, Italian, and Spanish. In the event of any inconsistency or conflict between the different language versions, the English version shall prevail. 

2. Specifications of the Products Offered

The products offered for sale are those listed on the Fly for Kidz website, subject to availability. Each product is carefully described and presented with photographs and specifications intended to reflect its main characteristics.

As Fly for Kidz products are handmade and often customizable, each item is unique. While we strive to present our creations as accurately as possible, the images and descriptions provided are for illustrative purposes only and have no contractual value.

Slight variations may occur between the product images and the items delivered, particularly regarding:

  • color tones (depending on lighting, image processing, or screen calibration),
  • finishing details due to handcrafted production,
  • accessories or decorative elements used in product staging.

Such variations are part of the charm and individuality of handmade work and shall not be considered defects or non-conformities, except in cases of significant discrepancies that could reasonably mislead the Customer.

Fly for Kidz sole proprietor, remains available to provide any additional information or clarifications before purchase. Customers are encouraged to contact us with any questions prior to placing an order.

3. Prices

Prices on the website are tax-inclusive in Swiss francs taking into account the VAT applicable on the day of the order. Any change in the rate will be reflected in product prices. Fly for Kidz sole proprietor reserves the right to change prices at any time and without notice, it being understood however that the price listed on the website on the day of the order shall be the only one applicable to the Customer. Prices listed outside the website (social networks, catalogs and other supports) are therefore not contractual and may be subject to change. Fly for Kidz sole proprietor reserves the right to not deliver products if their corresponding shown prices are incorrect and agrees to inform its customers about the price difference and will offer alternative products. Fly for Kidz sole proprietor may offer sales and promotions on its website.

These offers are only valid during the posting period on the site and cannot be applied retroactively.

Vouchers or discounts distributed on the site or through partner sites are only valid under the conditions established in the offer. These vouchers or discounts can only be used when ordering and must be entered in the field provided for this purpose. By no means can a voucher or discount be applied retroactively.

The shipping fees listed in the "shopping basket" of the order form are added to the listed prices.

4. Orders and Completion of the Sale

The Customer, who wishes to buy a product at the Fly for Kidz website, must go through the various stages of the purchase process (summary of the products selected and placed in the shopping basket, identification, address and choice of delivery and choice of payment and payment as provided). Confirmation of the order implies acceptance of the terms of sale, the recognition of having perfect knowledge of the same and waiver of any claims against these terms of sale or other conditions. All information provided and the registered confirmation shall constitute valid proof of the transaction. Confirmation shall constitute the signing and acceptance of the transactions made. Fly for Kidz sole proprietor will send the details of the order made via e-mail.

Payment for purchases made at www.flyforkidz.com is due at the time of the order, without discount. Payment may be made by Twint, credit card (Visa or MasterCard) or Postcard or via bank transfer. The Customer has 3 working days to pay via bank transfer; the order will be cancelled if no payment is done within this time.

Fly for Kidz sole proprietor does not have access to confidential information related to the payment method. The information entered is encrypted and securely transmitted to the company Stripe Inc. without Fly for Kidz sole proprietor or any third parties being able to access it.

5. Promotional Codes and Partner Offers

Promotional codes and partner offers are valid within the limits of their validity period and according to the specific conditions mentioned at the time they are communicated.

These benefits cannot be combined with each other or with other ongoing discounts (sales, special promotions, etc.).

For example, if you benefit from a partner offer allowing you to acquire a voucher at a preferential rate, you will not be able to add a discount code during your order.

Discounts are not retroactively applicable to already confirmed purchases and can under no circumstances be converted into cash.

We reserve the right to modify or discontinue a promotion or partnership at any time without prior notice.

6. Shipping

Fly for Kidz sole proprietor commits to informing customers of any delivery delay but cannot be held responsible for these delays nor give any form of compensation for these delays.

In case of damage during the transportation or if the product received is not as expected, a written notification should be sent to the Customer Service within 5 days after receipt of the parcel for any claims.

Deliveries are made to the shipping address specified by the customer during the ordering process.

6.1. Delivery Costs

The shipping cost is indicated in the "shopping basket" and is subject to the approval of the customer before the validation of each order and the amount may vary depending on the weight of the package, the amount of the order and country of delivery.

6.2. Production Time

Production times apply once payment has been received. As each product is handmade, and depending on the current workload, the production time is estimated to be between 1 and 5 business days.

The above production times apply to items that are in stock. Any additional delay applicable to out-of-stock items is indicated on the respective product page. Production of the order will begin only once all items included in the order are in stock.

Upon completion of the product, the customer will receive a confirmation photo if the option “Yes, with confirmation photo” has been selected during the checkout process. Should this option not be selected, the order will be dispatched without prior visual confirmation, and no claim may be made on this basis.

6.3. Delivery Time

Delivery times apply once the package is ready for shipment. Deliveries within Switzerland are carried out by Swiss Post, whose indicative delivery time is 2 to 3 working days. The customer will be notified by email once the goods have been handed over to the carrier.

6.4. Delay or loss of parcel

Fly for Kidz sole proprietor undertakes to hand over the goods to the carrier within the time limits indicated at the time of the order. The transfer of risk occurs as soon as the goods are handed over to the carrier. From that moment, Fly for Kidz sole proprietor cannot be held responsible in the event of delay, loss, theft or damage to the parcel.

Consequently:

  • Any modification of the delivery method or date decided by the carrier or by the buyer after shipment is their sole responsibility.
  • In the event of non-receipt while the parcel is indicated as delivered, it is the buyer’s responsibility to contact the carrier, file a complaint with the competent authorities and/or contact their home insurance.
  • No refund or reshipment of goods can be demanded, except in the case of proven fault on the part of Fly for Kidz sole proprietor.

Any assistance (inquiry with the carrier, etc.) is provided free of charge and does not constitute an acknowledgment of liability.

7. Guarantee for Defects and Withdrawal

7.1 Defective or Damaged Products

All Fly for Kidz products are handcrafted with care. If, exceptionally, a product is delivered damaged or presents a manufacturing defect, the customer must notify Fly for Kidz within five (5) calendar days from receipt of the order.

The customer may be required to provide photographic evidence clearly showing the defect or damage. Once the claim has been reviewed and approved, Fly for Kidz will, at its discretion and according to the customer’s preference, offer either:

  • a free replacement of the product, or
  • a full refund of the purchase price.

In such cases, the return of the defective product will not be required.

7.2 Incorrect Product

If the customer receives a product different from the one ordered, they must contact Fly for Kidz immediately and refrain from using the product. After verification, Fly for Kidz will provide an appropriate solution, which may include sending the correct product or issuing a refund.

7.3 Product Quality Guarantee

Fly for Kidz provides a thirty (30) day guarantee from the date of delivery covering manufacturing defects or abnormal deterioration resulting from proper and intended use of the product.

This guarantee does not cover damage caused by:

  • improper or negligent use,
  • impacts or accidents,
  • excessive biting or chewing,
  • prolonged exposure to water, or
  • inadequate handling or maintenance.

7.4 Proper Use and Care

To ensure product durability, safety, and validity of the guarantee, customers are required to follow the use and care instructions made available on the Fly for Kidz website. Proper use of the products is essential to maintain the guarantee and to ensure the safety of the child.

8. Guarantees and Liability

Fly for Kidz sole proprietor has taken all precautions to ensure both reliable information and secure access to its website www.flyforkidz.com

However, Fly for Kidz sole proprietor cannot, under any circumstances, guarantee the total absence of material error, technical defects or other unintended problems.

Likewise, no assurance can be given as to the suitability of the site for your particular needs and uses.

Fly for Kidz sole proprietor shall not be held responsible for any damage related to the use of its site and accepts no responsibility for the information contained in other sites that may be linked to it by a hypertext link or any other means.

9. Intellectual Property Rights

All data of any kind, including text, graphics, logos, icons, images, audio or video clips, trademarks, and software appearing on the Site are necessarily protected by copyright, trademark rights and other intellectual property rights.

Fly for Kidz sole proprietor, in its capacity as publisher of the Site, grants the User the right to private, non-collective and non-exclusive use of said content.

In these conditions, the User agrees not to reproduce, summarize, modify, alter or redistribute, without the express authorisation of the publisher, any text, title, application, software, logo, brand, information or illustration for any other use that is not strictly private, which excludes any representation for professional purposes or bulk redistribution.

Similarly, the User agrees not to copy all or part of the Site to another site or an internal corporate network. Fly for Kidz sole proprietor shall not be held responsible for any use made by Users of the data available on the Site.

The creation of hypertext links from another website to the Site must be expressly authorised by Fly for Kidz sole proprietor.

10. Personal Data Protection

Personal data is collected and processed in accordance with the Federal Act on Data Protection (FADP) and its implementing ordinance.

My Little Room SA is responsible for the processing of data collected and handled through the use of its website. For any questions regarding data processing or to exercise your rights, please refer to our Privay Policy. Requests may be submitted in accordance with the Privay Policy.

11. Terms of Use

Use of the website www.flyforkidz.com is for private use only. Any commercial use, particularly for the resale to third parties of products purchased on the site, is prohibited.

Any violation of this condition will be punishable by immediate and permanent exclusion from the circle of members. The damages are reserved.

12. Applicable Law and Jurisdiction

The contractual relationship between the Customer and Fly for Kidz sole proprietor, is governed exclusively by substantive Swiss law, with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 (CISG).

The place of jurisdiction for any dispute arising from or in connection with these General Terms of Sale shall be St. Gallen, Switzerland.

However, Fly for Kidz sole proprietor reserves the right to bring proceedings before the competent court at the Customer’s place of domicile or residence.
